Bayelsa Guber: Supreme Court Dismiss APC's Appeal for Review of Judgment.

The Supreme Court on Wednesday upheld its decision sacking David Lyon as Bayelsa State Governor-elect, and affirming Douye Diri as the winner of the last gubernatorial election in the State describing the call for a review of the judgment an abuse of court process, and lacking in merit.

The APC returned to the Supreme Court with an application urging it to reverse its decision of 13 February disqualifying its candidate in the governorship election.

The seven-member apex court panel led by Justice Sylvester Ngwuta said that the application by David Lyon and the APC seeking the review of the Apex Court's judgment is a call to violation of the country's Constitution.

In the judgment read by Justice Amina Augi, the Apex Court said it lacks jurisdiction to review its own decision as if that is done it will amount to become an appellate court.

The Apex Court, therefore, stressed that 'no force on earth can make it change its decision' insisting that it is final.

It said granting such an appeal will amount to opening the floodgates to other appeals of previous Supreme Court decisions.

Justice Augi said the only grounds to review its own decision is in the event of a clerical mistake, accidental slip or omission or to show any part of a judgment that needs to be varied.

The Apex Court, therefore, expressed regrets the Senior Lawyers in the class of Chief Afe Babalola, counsel to David Lyon and Wole Olanipekun, counsel to the APC will be seeking the Supreme Court to commit a constitutional breach.

 

As such the court awarded cost of #10million to be paid to each of the respondents, SenatorDuoye Diri, the PDP and Senator Lawrence Ehwrujakpor, the current Bayelsa State deputy governor.
